US, Exporters Settle Suit on AD Review on Indian Steel Flanges

The U.S. and exporters led by Kisaan Die Tech Private Limited told the Court of International Trade on Sept. 19 that they reached a settlement in a suit on the 2018-19 review of the antidumping duty order on stainless steel flanges from India (Kisaan Die Tech Private Limited v. United States, CIT # 21-00512).

As a result, Kisaan will get a 4.13% AD rate, exporter Echjay Forgings Private Limited will get a 1.7% AD rate, Bebitz Flanges Works Private Limited will get a 74.3% AD rate, and all other non-individually examined respondents will get a 5.2% AD rate.

The Commerce Department initially only selected one respondent in the review. In December 2023, the trade court ruled against Commerce's use of a 145.24% adverse facts available rate on the lone respondent in setting the rates for 15 non-individually examined companies (see 2312110043). The parties said that after the decision, they reached an agreement on how to resolve the case (see 2405240071).
