US Announces Intention to Settle Section 233 Steel Tariff Exclusion Denials Case

The U.S. and three importers filed a joint status report announcing they intend to settle several consolidated cases (see 2108190038) contesting the Commerce Department’s denials of the importers’ Section 233 steel tariff exclusion requests (Valbruna Slater Stainless.v. U.S., CIT #21-00027).

In September, the Court of International Trade rejected the government’s motion to dismiss the case (see 2309070037). DOJ argued that the entries in question in the dispute had already been liquidated for the last time, but CIT said the court may still reorder liquidation in Administrative Procedure Act cases under Section 1581(i) even if the prior liquidation was final.

CIT then granted the government a voluntary remand so that Commerce could reconsider its denials.

On Dec. 1, the parties filed a joint motion to stay further proceedings.
