CBP Releases UFLPA Detention 'Attachment,' Listing Product-Specific Documentation
CBP posted to its website an attachment it has been sending along with notices of detention under the Uyghur Forced Labor Detention Act that includes examples of documentation importers may submit to obtain a release, including for several products that only recently have come under CBP scrutiny.
CBP has been attaching the “addendum” to “provide importers examples and best practices from former reviews that may be helpful in providing supply chain documentation to request an applicability review,” the agency said. CBP posted the document to its website Jan. 4, but the document itself dates from Nov. 27.
Although less detailed than the “Operational Guidance for Importers” CBP released in 2022, the addendum includes more current information on product-specific documentation that should be provided to the agency in the event of a UFLPA detention. It includes examples of product-specific documentation for aluminum products, batteries, cotton products, polysilicon products, polyvinyl chloride (PVC) products, steel products and tires for automobiles and trucks.
The 2022 guidance included information only on documentation that may be submitted to obtain the release of cotton, polysilicon and tomatoes, the three products identified in UFLPA itself as an initial focus for CBP upon the law’s enactment (see 2107160003).
