Canadian Solar Cell Exporter Ditches Suit Against Anti-Circ Proceeding

Exporter Canadian Solar International Limited filed a Dec. 15 notice of dismissal at the Court of International Trade in its case challenging the Commerce Department's anti-circumvention finding on solar panels from Cambodia, Malaysia, Thailand and Vietnam. In the proceeding, Commerce found that solar panels from these nations are circumventing the antidumping and countervailing duty orders on crystaline silicon photovoltaic cells from China (Canadian Solar International v. United States, CIT # 23-00195).

Canadian Solar was one of many companies subject to the proceeding that took to the trade court to contest the affirmative circumvention result, arguing that three of the five factors weighed against a circumvention finding (see 2310190037). Canadian Solar said that it exports solar modules made by its affiliate, Canadian Solar Manufacturing (Thailand), to the U.S. market and that the company fully cooperated as a mandatory respondent in the review.

No reason was provided for why the exporter dismissed its case, and counsel for the firm didn't respond to a request for comment.
