CIT Postpones PI Hearing in UFLPA Entity List Challenge

The Court of International Trade in a Dec. 6 order postponed a hearing on Chinese exporter Ninestar Corp.'s motion for a preliminary injunction in the company's suit against its placement on the Uyghur Forced Labor Prevention Act Entity List. The parties asked for a delay in the hearing while they negotiate a process for the Forced Labor Enforcement Task Force to consider a request for removal from the UFLPA Entity List by Ninestar (see 2312050023) (Ninestar Corp. v. United States, CIT # 23-00182).

In the order, Judge Gary Katzmann granted Ninestar's motion for leave to file an amended complaint and ordered the company to propose an alternative schedule via another filing by Dec. 7 at 12 p.m. The amended complaint is deemed filed but remains confidential at the court.

The order comes on the heels of the trade court's decision finding it had subject matter jurisdiction to hear the suit (see 2311300038). The ruling on jurisdiction came after the exporter's motion for a preliminary injunction against the listing decision. The PI hearing now will be "rescheduled to a later date."
