Another 3D-Printing Pen Importer Argues for 'Toy' Classification
A U.S. importer of 3D-printing pens argued in the Court of International Trade that its pens should be reclassified as toys, or otherwise as either mechanical heating devices or motorized hand tools. Such an action would reduce or eliminate the antidumping duty for its products (Quantified Operations Limited v. U.S., CIT # 22-00178).
Quantified Operations Limited, a U.S. company that imports 3D-printing pen sets manufactured by the China-based Wobbleworks, Inc., filed its complaint Dec. 1. Wobbleworks filed a nearly identical complaint Nov. 23 for the pens of which it was the importer of record (see 2311290075).
After changing course several times, Commerce decided in 2019 the pens would be classified as machinery for working rubber or plastic, carrying an AD of 3.1%.
Wobbleworks and Quantified filed protests with CBP in June and November 2021, respectively. Both protests were denied.
In its complaint, Quantified said the pens should be classified as "toys" because they are brightly colored, often categorized as such by sellers and principally designed for amusement.
