AD Petitioner Asks CIT to Consolidate Shrimp From India Cases
Two cases involving the 2021-2022 administrative review of the antidumping duty order on frozen warmwater shrimp from India should be consolidated by the Court of International Trade, AD petitioner Ad Hoc Shrimp Trade Action Committee told the court in its Nov. 2 consolidation request (Ad Hoc Shrimp Trade Action Committee v. U.S., CIT # 23-00202; Megaa Moda Private Limited v. U.S., CIT # 23-00205).
Both cases involve the same administrative record and both challenge the same administrative determination, the committee said. In addition, both cases involve a "common question of law of fact" and both have already been assigned to Judge Thomas Aquilino. The committee argued that the similarities would not result in any increased burden on the court.
Finally, the committee said the counsels for DOJ, for Indian exporter Megaa Moda, and for defendant-intervenor the American Shrimp Processors Association, had all agreed to a consolidation.
