CIT Grants Stay Pending Importer's CCR Request in Customs Suit on Ammonium Sulfate Isotope

The Court of International Trade stayed a customs case concerning importer Cambridge Isotope Laboratories' enriched ammonium sulfate isotope until Dec. 11, given that Cambridge is consulting with the relevant antidumping and countervailing duty petitioners for a "partial revocation of the AD/CVD Orders on Ammonium Sulfide from China." Cambridge filed suit to contest CBP's assessment of the AD/CVD on the imports (see 2308300052) (Cambridge Isotope Laboratories v. United States, CIT # 23-00080).

The importer asked the court for a stay since it is working with the domestic industry to partially revoke the orders for the goods at issue -- an enriched ammonium sulfate isotope -- that will lead the importer to file a second changed circumstances petition with the Commerce Department on or before Dec. 11.

Judge M. Miller Baker said that should Cambridge tell the court on or before Dec. 11 that it filed the changed circumstances review petition, the stay will be extended. If no petition is filed, the parties shall file a joint status report by Dec. 26, the court said.
