ITC Issues Revision 2 to 2023 HTS, Implementing Russian Aluminum Import Tariffs
The International Trade Commission recently released Revision 2 to the 2023 Harmonized Tariff Schedule, adding four HTS subheadings under chapter 99 to implement Presidential Proclamation 10522 of Feb. 24, "Adjusting Imports of Aluminum Into the United States."
Subheadings 9903.85.67 and 9903.85.69 add 200% additional duties to the following aluminum articles that are products of Russia, including those admitted into a U.S. foreign-trade zone under "privileged foreign status" before March 10, 2023: Unwrought aluminum of heading 7601; bars, rods and profiles of heading 7604; wire of heading 7605; plates, sheets and strips of heading 7606; foil of heading 7607; tubes, pipes and tube or pipe fittings of headings 7608 and 7609; and castings and forgings of aluminum of subheading 7616.99.51.
The newly added U.S. note 19(a)(vii) explains that no duty exemption or reduction shall be allowed for these products that would otherwise allow a lower duty rate or provide duty-free treatment.
Subheadings 9903.85.68 and 9903.85.70 add 200% additional duties to the following "derivative" aluminum articles that are products of Russia, including those admitted into a U.S. foreign-trade zone under "privileged foreign status" before March 10, 2023: Stranded wire, cables, plaited bands, and the like in subheadings 7614.10.50, 7614.90.20, 7614.90.40, and 7614.90.50; bumper stampings of aluminum, the foregoing comprising parts and accessories of the motor vehicles of headings 8701 to 8705; and body stampings of aluminum, for tractors suitable for agricultural use in subheading 8708.29.21.
