Tin Mill Products: New AD/CVD Investigations Deadlines & Scope

The Commerce Department issued notices in the Federal Register on its recently initiated antidumping duty investigations on tin mill products from Canada, China, Germany, the Netherlands, South Korea, Taiwan, Turkey and the U.K. (A-122-869, A-570-150, A-428-851, A-580-915, A-421-816, A-583-870, A-489-848, A-412- 827), and its countervailing duty investigation on tin mill products from China (C-570-151). The CVD investigation covers entries for the calendar year 2022. The AD investigations on Canada, Germany, Netherlands, South Korea, Taiwan, Turkey and the U.K. cover the period Jan. 1, 2022, through Dec. 31, 2022, and the AD investigation on China covers entries July 1, 2022, through Dec. 31, 2022.

The International Trade Commission will conduct a concurrent investigation to determine whether imports of dumped and illegally subsidized tin mill products are injuring U.S. industry. If the ITC finds no injury in its preliminary injury determination, due March 6, the investigations will immediately end. If Commerce finds dumping or illegal subsidization in the preliminary determinations of these investigations, currently due in April for CVD and June for AD,it will set AD and/or CVD cash deposit requirements for imports of merchandise subject to the investigation. If both Commerce and the ITC reach affirmative final determinations, Commerce will issue orders making duties permanent and begin a process of annual administrative reviews to set final assessments of AD/CVD on importers and potentially change AD/CVD cash deposit rates.

If duties are imposed, Chinese producers and exporters that do not demonstrate independence from government control and request eligibility for a “separate rate” will be assigned the antidumping duty “China-wide rate," which can reach more than 200% for some products. Separate rate applications from Chinese producers and exporters will be available (here), and are due on or about March 16.

AD/CVD Respondent Selection

Commerce said it will pick respondents to its CV investigation on China based on CBP import data.

For its AD duty investigations, Commerce will pick the only known producers as the sole respondents for Canada (ArcelorMittal Dofasco G.P.), Germany (ThyssenKrupp Rasselstein GmbH), the Netherlands (Tata Steel Netherlands and Tata Steel Ijmuiden, B.V.), Taiwan (Ton Yi Industrial Corporation) and the U.K. (Tata Steel UK Limited).

For the AD investigations on South Korea and Turkey, Commerce intends to rely on CBP import data to select respondents.

For the AD investigation on China, Commerce sent quantity and value questionnaires to each potential respondent, and will base respondent selection on the responses it receives. Exporters that don't get a quantity and value questionnaire can submit one using the forms that will be made available on the Commerce website. Responses are due Feb. 21.

Scope of the AD/CVD Investigations

“The products within the scope of these investigations are tin mill flat-rolled products that are coated or plated with tin, chromium or chromium oxides. Flat-rolled steel products coated with tin are known as tinplate. Flat-rolled steel products coated with chromium or chromium oxides are known as tin-free steel or electrolytic chromium-coated steel. The scope includes all the noted tin mill products regardless of thickness, width, form (in coils or cut sheets), coating type (electrolytic or otherwise), edge (trimmed, untrimmed or further processed, such as scroll cut), coating thickness, surface finish, temper, coating metal (tin, chromium, chromium oxide), reduction (single- or double-reduced), and whether or not coated with a plastic material.

“All products that meet the written physical description are within the scope of these investigations unless specifically excluded. The following products are outside and/or specifically excluded from the scope of these investigations:

“The merchandise subject to these investigations is currently classified in the Harmonized Tariff Schedule of the United States (HTSUS), under HTSUS subheadings 7210.11.0000, 7210.12.0000, 7210.50.0020, 7210.50.0090, 7212.10.0000, and 7212.50.0000 if of non-alloy steel and under HTSUS subheadings 7225.99.0090, and 7226.99.0180 if of alloy steel. Although the subheadings are provided for convenience and customs purposes, the written description of the scope of the investigations is dispositive.”

Comments on the scope of these investigations are due by Feb. 27.
