New AD/CV Duties Requested on Tin Mill Products

A U.S. manufacturer and a labor union seek the imposition of new antidumping duties on tin mill products from Canada, China, Germany, the Netherlands, South Korea, Taiwan, Turkey and the U.K., as well as new countervailing duties on tin mill products from China, they said in petitions filed with the Commerce Department and the International Trade Commission Jan. 18. Commerce will now decide whether to begin AD/CVD investigations, which could result in the imposition of permanent AD/CVD orders and the assessment of AD and CVD on importers. Cleveland-Cliffs and the United Steelworkers Union filed the petitions.

An AD order has been in place on tin mill products from Japan since 2000. Tin mill products are also subject to Section 232 tariffs, and some are also subject to List 4A Section 301 tariffs at a rate of 7.5%.

Proposed Scope

The petition proposes the following scope for the investigations:

"The products within the scope of these investigations are tin mill flat-rolled products that are coated or plated with tin, chromium, or chromium oxides. Flat-rolled steel products coated with tin are known as tinplate. Flat-rolled steel products coated with chromium or chromium oxides are known as tin-free steel or electrolytic chromium-coated steel. The scope includes all the noted tin mill products regardless of thickness, width, form (in coils or cut sheets), coating type (electrolytic or otherwise), edge (trimmed, untrimmed or further processed, such as scroll cut), coating thickness, surface finish, temper, coating metal (tin, chromium, chromium oxide), reduction (single- or double-reduced), and whether or not coated with a plastic material.

"All products that meet the written physical description are within the scope of the investigations unless specifically excluded. The following products, by way of example, are outside and/or specifically excluded from the scope of the investigations:

"The merchandise subject to these investigations is currently classified in the Harmonized Tariff Schedule of the United States (HTSUS), under HTSUS subheadings 7210.11.0000, 7210.12.0000, 7210.50.0000, 7212.50.0020, 7212.50.0090, 7212.10.0000, and 7212.50.0000 if of non-alloy steel and under HTSUS subheadings 7225.99.0090, and 7226.99.0180 if of alloy steel. Although the subheadings are provided for convenience and customs purposes, the written description of the scope of the investigations is dispositive."

Commerce Accepting Comments on Petition Support

The Commerce Department is accepting comments on domestic industry support for the petitions to determine whether the petitions meet the dual requirements of support by domestic producers or workers accounting for (1) at least 25% of the total production of the domestic-like product and (2) more than 50% of the production of the domestic-like product produced by that portion of the industry expressing support for, or opposition to, the petition. If the petitions meet these requirements, among others, Commerce will initiate antidumping and countervailing duty investigations. Comments are due by Jan. 31.
