ITC Issues Semiannual Revision to 2022 HTS; Changes Effective as of July 1

The International Trade Commission posted Revision 6 to the 2022 Harmonized Tariff Schedule. The semiannual update to the HTS adds new 10-digit tariff numbers for a variety of products, including tomatoes and a wide range of other vegetables, cut flowers and beverages in aluminum cans. All changes take effect July 1, unless otherwise specified.

Bone-in beef cuts. Subheading 0201.20.5055 for bone-in, fresh or chilled brisket imported under additional note 3 to chapter 2 (i.e., from Canada, Mexico or in-quota from other countries) is removed from the tariff schedule. Likewise, subheadings 0202.20.5055, 0202.20.5065 and 0202.20.5075 for bone-in, frozen brisket cuts, hip cuts and flank or plate cuts, respectively, imported from Canada, Mexico or in-quota from other countries, are also eliminated.

Cut flowers. New 10-digit provisions are added under subheading 0603.19.01 for aster (0603.19.0112), calla lilies (0603.19.0114), delphinium (0603.19.0116), hydrangea (0603.19.0125) and tulips (0603.19.0145). Subheading 0603.19.0160 for “other” fresh cut flowers is renumbered 0603.19.0190.

Potatoes. Provisions for potatoes, fresh or chilled, other than seed, other than yellow, in immediate containers not over 1200kg net weight are reorganized. “Certified organic” has been added as 0701.90.5005. “Russet or netted gem varieties” have been renumbered to 0701.90.5017. “Red skin varieties” have been renumbered to 0701.90.5021. “Other” has been renumbered to 0701.90.5040

Tomatoes. Provisions for tomatoes, fresh or chilled, classified under subheadings 0702.00.20, 0702.00.40 and 0702.00.60 depending on the time of year they were entered, have been reorganized.

For tomatoes entered March 1 to July 14 or Sept. 1 to Nov. 14, "certified organic” greenhouse tomatoes have been added under subheading 0702.00.2016. Non-organic greenhouse cherry tomatoes have been added as 0702.00.2019. Non-organic greenhouse grape tomatoes have been added as 0702.00.2026. Greenhouse Roma tomatoes have been renumbered as 0702.00.2032. Greenhouse “round” tomatoes have been renumbered as 0702.00.2036 and “other” non-organic greenhouse tomatoes have been renumbered as 0702.00.2042.

Non-greenhouse tomatoes have also been reorganized. A “certified organic” category was added under subheading 0702.00.2046. Non-organic cherry tomatoes have been renumbered to 0702.00.2052, grape tomatoes to 0702.00.2062, Roma tomatoes to 0702.00.2066, “round” tomatoes to 0702.00.2081, and “other” non-greenhouse, non-organic tomatoes to 0702.00.2092.

For tomatoes entered between July 15 and Aug. 31, "certified organic” greenhouse tomatoes have been added under subheading 0702.00.4016. Non-organic greenhouse cherry tomatoes have been added as 0702.00.4019. Nonorganic greenhouse grape tomatoes have been added as 0702.00.4021. Greenhouse Roma tomatoes have been renumbered as 0702.00.4023. Greenhouse “round” tomatoes have been renumbered as 0702.00.4027 and “other” nonorganic greenhouse tomatoes have been renumbered as 0702.00.4032.

Non-greenhouse tomatoes have also been reorganized. A “certified organic” category was added under subheading 0702.00.4037. Nonorganic cherry tomatoes have been renumbered to 0702.00.4041, grape tomatoes to 0702.00.4047, Roma tomatoes to 0702.00.4066, “round” tomatoes to 0702.00.4081, and “other” non-greenhouse, non-organic tomatoes to 0702.00.4092.

For tomatoes entered between Nov 15. and the end of the following February, “Certified organic” greenhouse tomatoes have been added under subheading 0702.00.6016. Nonorganic greenhouse cherry tomatoes have been added as 0702.00.6019. Nonorganic greenhouse grape tomatoes have been added as 0702.00.6021. Greenhouse Roma tomatoes have been renumbered as 0702.00.6023. Greenhouse “round” tomatoes have been renumbered as 0702.00.6027 and “other” nonorganic greenhouse tomatoes have been renumbered as 0702.00.6032.

Non-greenhouse tomatoes have also been reorganized. A “certified organic” category was added under subheading 0702.00.6036. Nonorganic cherry tomatoes have been renumbered to 0702.00.6039, grape tomatoes to 0702.00.6046, Roma tomatoes to 0702.00.6066, “round” tomatoes to 0702.00.6081, and “other” non-greenhouse, non-organic tomatoes to 0702.00.6092.

Edible Brassicas. Provisions for other edible brassicas including sprouting broccoli, fresh or chilled, the “other” subheading has been further broken out into subheadings for bok choy (0704.90.4015), collards (0704.90.4025), and kale (0704.90.4035), and “other” was renumbered to 0704.90.4050. Sprouting broccoli remains classifiable under subheading 0704.90.4020.

Cucumbers. Provisions for cucumbers including gherkins have been reorganized to add provisions for organic cucumbers. The subheading for cucumbers entered between Dec. 1 to the end of February have been broken out into provisions for “certified organic” in 0707.00.2010 and “other” in 0707.00.2020. Cucumbers entered between March 1 and April 30 have been broken out into “certified organic” as 0707.00.4010 and “other” as 0707.00.4020.

Cucumbers entered between May 1 and June 30 or between Sept. 1 and Nov. 30 have been further broken out. Greenhouse cucumbers have been split into “certified organic” (0707.00.5020) and “other” (0707.00.5040). Non-greenhouse cucumbers have been split into “certified organic” (0707.00.5070) and “other” (0707.00.5080).

The same goes for provisions for cucumbers entered between July 1 and Aug. 31. Greenhouse cucumbers have been split into “certified organic” (0707.00.6015) and “other” (0707.00.6020). Non-greenhouse cucumbers exceeding 15 cm (in length and presented in bulk quantities of 453.6 kg (1,000 lbs) or more have been split into “certified organic” (0707.00.6060) and “other” (0707.00.6070).

Peppers. Non-chili peppers have been reorganized and expanded. Greenhouse-grown certified organic sweet bell peppers have been broken out into provisions for green (0709.60.4005), red (0709.60.4007), yellow (0709.60.4009), orange (0709.60.4011), and “other” (0709.60.4013) peppers. Non-organic sweet bell peppers have been broken out into 10-digit subheadings for green (0709.60.4017), red (0709.60.4022), yellow (0709.60.4027), orange (0709.60.4032), and “other” (0709.60.4037) peppers.

Non-greenhouse-grown peppers have undergone similar treatment. Provisions for certified organic peppers have been broken out into separate subheadings for green (0709.60.4060), red (0709.60.4063), yellow (0709.60.4066), orange (0709.60.4069) and “other” (0709.60.4072) peppers.

Non-organic peppers used for freezing, pickling/brining or as ingredients in other value-added products, and not intended for immediate retail sale (as described in statistical note 3 to Chapter 7) are now numbered as 0709.60.4074.

Breakouts for non-organic green (0709.60.4078), red (0709.60.4081), yellow (0709.60.4084), orange (0709.60.4087), and “other” (0709.60.4091) were also added to the tariff schedule

Squash. Certified organic squash has been further broken out into provisions for zucchini (0709.93.2020), yellow straightneck (0709.93.2030) and “other” (0709.93.2040) squash.

Frozen vegetables. For "other" frozen vegetables reduced in size, other than brussels sprouts or okra, a new provision has been been added for garlic, reduced in size beyond the clove (0710.80.9755). The “other” subcategory has been renumbered to 0710.80.9765.

Garlic within vegetable mixtures. For vegetables other than tomatoes, mushrooms and potatoes, prepared or preserved without vinegar or acetic acid, frozen, other than products of heading 2006, provisions have been added for garlic in peeled clove form (2004.90.8565), “reduced in size beyond the clove” (2004.90.8575), and “other” (2004.90.8585) forms. A provision for "other" such vegetables and mixtures, other than antipasto, beans, carrots, sweet corn, or peas, has been renumbered to 2004.90.8595.

Beverages. Provisions for various beverages have been separated into those contained in aluminum containers or otherwise.

Carbonated soft drinks containing high-intensity sweeteners have been separated into those coming in aluminum containers (2202.10.0045) and not (2202.10.0055).

Other types of sweetened or flavored waters have also been separated into those coming in aluminum containers (2202.10.0065) and not (2202.10.0075).

Non-alcoholic beer has been separated into those coming in aluminum containers (2202.91.0010) and not (2202.91.0020).

Other non-alcoholic beverages, besides water and flavored waters, soft drinks, non-alcoholic beers, fortified fruit juices or milk-based drinks have been separated into those coming in aluminum containers (2202.99.9110) and not (2202.99.9120).

Fermented beverages other than cider, prune wine, rice wine, or effervescent wine, as well as mixtures of fermented beverages and non-alcoholic beverages not elsewhere specified, ready to consume as packages of 4 liters or less has also been separated into provisions for aluminum (2206.00.9010) or other (2206.00.9020) containers.

For other fermented beverages, new breakouts are also added for aluminum (2206.00.9030) or other (2206.00.9040) containers.

Ethyl Alcohol and spirits. Provisions for spirits and ethyl alcohol less than 80 percent alcohol by volume, other than rum, gin, vodka, whiskey, liqueurs, aquavit, bitters, brandy, tequila, kirschwasser, or spirits, has been broken down into premixed cocktails or mixed beverages, ready to consume as packaged, in containers each holding not over 4 liters as 2208.90.8010 and “other” as 2208.90.8020.

Medical gloves. Gloves, mittens, and mitts for medical purposes have been broken out into medical (4015.12.1010) and surgical (4015.12.1020) subcategories.

Textiles. New tariff provisions are added for nonwoven textiles of man-made filaments, ready-to-use articles packaged for sale, whether or not separated, perforated or impregnated, for nonwovens weighing 25 g/m2 or less (5603.11.0070), between 25 g/m2 and 70 g/m2 (5603.12.0070), and between 70 g/m2 and 150 g/m2 (5603.13.0070).

Textiles neither ready-to-use nor impregnated or coated with material other than rubber have been renumbered for items weighing 25 g/m2 or less (5603.11.0095), between 25 g/m2 and 70 g/m2 (5603.12.0095), and Between 70 g/m2 and 150 g/m2 (5603.13.0095).

Likewise, for nonwoven not made from man-made filaments, similar provisions have been added for ready-to-use articles packaged for sale, whether or not separated, perforated or impregnated, weighing between 25 g/m2 and 70 g/m2 under new 10-digit subheading 5603.92.0070. Similar items neither ready-to-use nor impregnated or coated with material other than rubber have been renumbered to 5603.92.0095.

Steel bars and rods. Various subcategories of hot-rolled bars and rods of irregularly wound coils, other than concrete reinforcement or free-cut steel or circular cross-section measuring less than 14mm in diameter have had their product descriptions corrected to refer to the correct statistical notes in chapter 72. Tire cord-quality steel wire rod (7213.91.3011) now correctly refers to statistical note 5. Cold Heading Quality steel (7213.91.3015) now correctly refers to statistical note 6. Welding quality wire rods (7213.91.3020) now correctly refers to statistical note 7.

Stairless steel spring round wire (7223.00.1005) now correctly refers to statistical note 8 of chapter 72 in its product description.

Hot-rolled bars and rods of irregularly wound coils of silico-manganese steel (7227.20.0030) now correctly refers to statistical note 7 of chapter 72.

Hot-rolled bars and rods of irregularly wound coils other than silico-manganese steel and other than tool-steel of Cold Heading Quality (7227.90.6010) now correctly refers to statistical note 6 and of welding quality wire rods (7227.90.6020) now correctly refers to statistical note 7.

Metal furniture. Metal furniture other than seats or medical furniture and other than office or household furniture has had a subcategory added for steel racks other than boltless or press-fit steel shelves (9403.20.0082) and the “other” category has been renumbered to 9403.20.0086.
