India Barium Chloride: New AD/CVD Investigations Deadlines & Scope
The Commerce Department issued notices in the Federal Register on its recently initiated antidumping and countervailing duty investigations on barium chloride from India (A-533-908/C-533-909). Both the AD and CV duty investigations cover entries Jan. 1 - Dec. 31, 2021.
The International Trade Commission will conduct a concurrent investigation to determine whether imports of dumped and illegally subsidized barium chlorides from India is injuring U.S. industry. If the ITC finds no injury in its preliminary injury determination, due Feb. 28, the investigations will immediately end. If Commerce finds dumping or illegal subsidization in the preliminary determinations of these investigations, due in April for CV duties and June for AD duties, it will set AD and/or CV duty cash deposit requirements for imports of merchandise subject to the investigation. If both Commerce and the ITC reach affirmative final determinations, Commerce will issue an AD and/or CV duty order making duties permanent and beginning a process of annual administrative reviews to set final assessments of AD/CV duties on importers and potentially change AD/CV duty cash deposit rates.
AD/CVD Respondent Selection
Commerce intends to use CBP data to pick respondents to its AD and CV duty investigations. Comments are due Feb. 11.
Scope of the AD/CVD Investigations
The merchandise covered by this investigation is barium chloride, a chemical compound having the formulas BaCl2 or BaCl2 -2H2 O, currently classifiable under subheading 2827.39.4500 of the Harmonized Tariff Schedule of the United States (HTSUS). Although the HTSUS subheading is provided for convenience and customs purposes, the written description of the scope of this investigation is dispositive.
Comments on the scope of these investigations are due by Feb. 22.
