Petition Filed for New AD/CV Duties on OCTG From 4 More Countries

A group of domestic manufacturers and a labor union seek the imposition of new antidumping duties on oil country tubular goods from Argentina, Mexico and Russia, and new countervailing duties on oil country tubular goods from South Korea and Russia, they said in a petition filed with the Commerce Department and the International Trade Commission Oct. 5. Commerce will now decide whether to begin AD/CVD investigations, which could result in the imposition of permanent AD/CV duty orders and the assessment of AD and CV duties on importers.

The petition was filed by Borusan Mannesmann Pipe U.S., Inc., PTC Liberty Tubulars LLC, U.S. Steel Tubular Products, Inc., the United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial and Service Workers International Union, and Welded Tube USA.

Any CV duties imposed on South Korea would come on top of an antidumping duty order already in place for the country. Existing AD duty orders also cover OCTG from China, India, Turkey, Ukraine and Vietnam, and existing CV duty orders cover OCTG from China, India and Turkey.

Proposed Scope

The petition proposes the following scope for the investigations, which is "identical to the scope of the AD/CVD orders on India, Korea, Turkey, Ukraine and Vietnam, with the addition of language confirming that imports of OCTG manufactured in the subject countries but packaged, finished, or processed in third countries remains in the scope of the investigations," the petition said:

The investigation covers certain oil country tubular goods (OCTG), which are hollow steel products of circular cross-section, including oil well casing and tubing, of iron (other than cast iron) or steel (both carbon and alloy), whether seamless or welded, regardless of end finish (e.g., whether or not plain end, threaded, or threaded and coupled) whether or not conforming to American Petroleum Institute (API) or non-API specifications, whether finished (including limited service OCTG products) or unfinished (including green tubes and limited service OCTG products), whether or not thread protectors are attached. The scope of the investigation also covers OCTG coupling stock.

Subject merchandise includes material matching the above description that has been finished, packaged, or otherwise processed in a third country, including by performing any heat treatment, cutting, upsetting, threading, coupling, or any other finishing, packaging, or processing that would not otherwise remove the merchandise from the scope of the investigations if performed in the country of manufacture of the OCTG.

Excluded from the scope of the order are: casing or tubing containing 10.5 percent or more by weight of chromium; drill pipe; unattached couplings; and unattached thread protectors.

Commerce Accepting Comments on Petition Support

The Commerce Department is accepting comments on domestic industry support for the petition to determine whether the petition meets the dual requirements of support by domestic producers or workers accounting for (1) at least 25% of the total production of the domestic-like product and (2) more than 50% of the production of the domestic-like product produced by that portion of the industry expressing support for, or opposition to, the petition. If the petition meets these requirements, among others, Commerce will initiate antidumping and countervailing duty investigations. Comments are due on or about Oct. 25.
