Commerce Finalizes AD/CV Duties on Corrosion-Resistant Steel From Malaysia
Imports of corrosion-resistant steel from Malaysia are subject to antidumping and countervailing duty orders on corrosion-resistant steel from China and Taiwan, the Commerce Department said in final determinations from anti-circumvention inquiries covering the two countries (A-570-026/C-570-027, A-583-856). Commerce continued to find producers in Malaysia are taking hot-rolled steel and cold-rolled steel from China and Taiwan and turning it into corrosion-resistant steel before exporting it to the U.S., in circumvention of AD/CV duties.
As a result, Commerce will direct CBP to continue to suspend liquidation for merchandise from Malaysia that are covered by these inquiries and entered on or after Aug. 12, 2019. Commerce will also require AD duty cash deposits for such entries at the 199.43% China-wide rate and CV duties at the 39.05% “all others” rate for the AD/CV duty orders on corrosion-resistant steel products from China, unless the importer can certify the merchandise was made from hot-rolled or cold-rolled steel from Taiwan, in which case only the 3.66% all others AD rate for corrosion-resistant steel products from Taiwan will apply, the agency said.
Commerce also issued a final negative determination in its anti-circumvention inquiry on corrosion-resistant steel products from South Africa. The agency recently finalized similar anti-circumvention inquiries that subjected merchandise from Costa Rica and the United Arab Emirates to AD duties on corrosion-resistant steel from China, and found no circumvention by imports from Guatemala (see 2007100018).
To avoid AD/CV duties on corrosion-resistant steel products from Malaysia, importers and exporters must continue to complete and maintain certifications that their products were not made from hot-rolled steel or cold-rolled steel flat products from China or Taiwan. Importers that do not certify will be subject to AD duties at rates applicable to Chinese importers. The importer must complete the certification by the date of entry, and the exporter must complete it by the date of shipment. Corrosion-resistant steel products from several Malaysian companies -- Hsin Kuang Steel Co. Ltd; FIW Steel Sdn Bhd; Nippon EGalv Steel Sdn Bhd; NS BlueScope Malaysia Sdn Bhd; and YKGI/Yung Kong Galv. Ind/Starshine Holdings Sdn Bhd/ASTEEL Sdn Bhd -- are ineligible for certification. Entries from these companies will automatically face AD/CV duties at rates applicable to Chinese corrosion-resistant steel products.
