Sewing Thread Subject to AD/CV Duties on Polyester Textured Yarn, Commerce Says
Sewing thread made from polyester textured yarn is still subject to antidumping and countervailing duty orders on polyester textured yarn from India and China (A-533-885/C-533-886, A-570-097/C-570-098), the Commerce Department said in a March 22 scope ruling. The importer of the thread, American & Efird, had argued sewing thread is not subject to the AD/CVD orders, but Commerce found the duties cover polyester textured yarn in “all forms.”
American a& Efird’s Wildcat Plus Tex 35 sewing thread consists of two distinct folded strands and multiple filaments, twisted and finished with a silicon-type finish. Polyester partially oriented yarn is first converted into textured yarn, then the two yarns are combined, doubled, twisted into a final “Z” twist and coated with a silicone lubricant.
According to Commerce, despite its use as sewing thread, the merchandise imported by American & Efird is still subject to AD/CV duties on polyester textured yarn. The scope of the AD/CVD orders “contains no end use language and specifies that subject merchandise includes ‘all forms of polyester textured yarn, regardless of surface texture or appearance, yarn density and thickness (measured in denier), number of filaments, number of plies, finish (luster), cross section, color, dye method, texturing method, or packing method (such as spindles, tubes, or beams,’” Commerce said.
“The description of the product and production of the product provided by American & Efird confirm that the product is a form of polyester textured yarn, as it is made by combining two polyester textured yarns, twisting them, and putting a lubricating finish on the product. …,” Commerce said. “None of the physical attributes described by American & Efird exclude the product from the scope of the Orders, which covers all forms of polyester textured yarn regardless of ply, texturing method, and finish.”
