USTR Extends Some Lists 1 and 2 Exclusions From Section 301 Tariffs, Leaves Many to Expire Sept. 20
More than 300 exclusions from lists 1 and 2 Section 301 China tariffs are set to expire Sept. 20, after the Office of the U.S. Trade Representative declined to extend them in the run-up to their expiration.
In two notices released Sept. 17, USTR granted extensions to some of the exclusions that are due to expire. But the agency only extended 62 out of 306 exclusions from List 1 tariffs under U.S. Note 20(q) that are filed under Harmonized Tariff Schedule of the United States subheading 9903.88.14, and only 17 out of 86 List 2 exclusions under U.S. Note 20(v) and HTS subheading 9903.88.17. The extended exclusions are now valid until Dec. 31.
The extended List 1 exclusions will now be listed in U.S. Note 20(kkk) and filed under subheading 9903.88.58. The extended List 2 exclusions will be listed in U.S. Note 20 (lll) and filed under subheading 9903.88.59.
USTR had issued both sets of exclusions on Sept. 20, 2019, with a validity of one year (see 1909180013). The agency sought comment in two notices issued in June on whether to extend any of exclusions (see 2006020014 and 2006240026).
