BIS Adds 11 Chinese Entities to Entity List for Xinjiang Human Rights Violations
The Commerce Department will add 11 China-based entities to its Entity List for their involvement in human rights abuses in China’s Xinjiang region, a notice released July 20 said. Nine of the entities are involved in the forced labor of Muslim minority groups and two conduct “genetic analyses” to “further the repression” of the minorities, Commerce said. The additions take effect July 22.
Commerce will impose a license requirement for exports to the entities for all items subject to the Export Administration Regulations. The agency will review license applications case by case for certain Export Control Classification Numbers and for EAR items necessary to detect, identify and treat infectious diseases. BIS will impose a presumption of denial for “all other items” subject to the EAR, and said no license exceptions will be available.
All shipments now requiring a license as a result of this rule but that were on dock for loading or aboard a carrier to a port as of July 22 may proceed to their destinations under the previous eligibility, the agency said.
The agency will also revise 37 existing Chinese entries to update their license review policy. Commerce will impose a case-by-case review policy for all EAR items used to combat infectious diseases “in light of the current global pandemic.” The agency also revised the name and location for two of the entries to change the spelling of “Uighur” to “Uyghur.”
Commerce Secretary Wilbur Ross said Beijing is “actively” promoting forced labor and involuntary biometric data collection and data analyses of the minority groups. “This action will ensure that our goods and technologies are not used in the Chinese Communist Party’s despicable offensive against defenseless Muslim minority populations,” Ross said.
