Aug. 21 CBP Bulletin Proposes to Revoke Rulings on Arm Sleeves, Costume Gloves
In the Aug. 21 Customs Bulletin (Vol. 53, No. 29), CBP published notices that propose to revoke rulings and similar treatment for arms sleeves and gloves.
Comments on Proposals Due Sept. 20
CBP said consideration will be given to any written comments received by Sept. 20 before taking this action. In addition, any party who has received a ruling or decision on the merchandise that is subject to the proposed revocations or modifications, or any party involved with a substantially identical transaction, should advise CBP by the date that written comments on the proposed ruling are due. (An importer's failure to advise CBP of such rulings, decisions or substantially identical transactions may raise issues of reasonable care on the part of the importer or its agents for importations subsequent to the effective date of the final decision in this notice.)
Proposals
CBP is proposing to revoke or modify the rulings below, and any rulings on these products that may exist but have not been specifically identified. CBP is also proposing to revoke any treatment it has previously accorded to substantially identical transactions.
Arm Sleeves
Item: Sleeves that provide compression support during training, fitness, exercise and other sports related activities |
Current: 6117.80.9540, 14.6%, “Other made up clothing accessories, knitted or crocheted; knitted or crocheted parts of garments or of clothing accessories: Other accessories: Other: Other, Of man-made fibers: Other." |
Proposed: 6307.90.98.89, 7%, “Other made up articles, including dress patterns: Other: Other: Other:Other." |
Reason: The arm sleeves don't meet the definition of a clothing accessory and are more similar to support articles, CBP said. |
Proposed for revocation: NY N258826 (2014) |
Proposed new ruling: HQ H262218 |
Costume Gloves
Item: Gloves shaped like the hands of Mickey Mouse, other cartoons, or a werewolf |
Current: 9505.90.60, duty-free, “Festive, carnival or other entertainment articles, ....: Other: Other: Other." |
Proposed: 6116.93.88, 18.6% "Gloves, mittens and mitts, knitted or crocheted: Other: Of synthetic fibers: Other: Without fourchettes.” |
Reason: Since the articles involved are either gloves or a mitt, classification in chapter 95 is expressly precluded, said CBP. The articles are instead classified by their constituent material. |
Proposed for revocation: NY B87119 (1997), NY N006668 (2007) |
Proposed new ruling: HQ H261881 |
