Trade-Related Court Cases Filed for Week of Sept. 25 - Oct. 1

The following lawsuits were filed at the Court of International Trade during the week of Sept. 25 - Oct. 1:

L&N Trading, on the assessment of AD duties on its imports of honey from Malaysia. L&N says CBP improperly determined the honey was of Chinese origin and subject to the AD duty order on honey from China. #17-00242. Filed Sept. 27.

Iron Bow Technologies and Vivify Health, challenging a recent CBP ruling that found its tablet computers made in Vietnam and programmed with proprietary software in the U.S. are of Vietnamese origin for government procurement purposes (see 1708250019). #17-00243. Filed Sept. 27.

Sumecht NA, dba Sumec North America, challenging Commerce's decision to order assessment of AD duties at 238.95% on its imported solar cells from China. Sumec said the new rate was improper because Commerce had not yet issued a "Timken notice" announcing the high rate, which was the result of a CIT decision from before the merchandise was entered. #17-00244. The following appeals of Court of International Trade decisions were filed at the U.S. Court of Appeals for the Federal Circuit during the week of Sept. 25 - Oct. 1:

ITG Voma Corporation, China Rubber Industry Association and Sub-Committee of Tire Producers of the China Chamber of Commerce of Metals, Minerals & Chemical Importers, challenging a July CIT decision sustaining the International Trade Commission's final affirmative injury determination in the antidumping and countervailing duty investigations on passenger vehicle and light truck tires from China. #17-2618, -2619.
