CBP Withdraws Revised Form 5106 From Review Process

CBP withdrew its revised Form 5106 from review at the Office of Information and Regulatory Affairs on May 8, according to the OIRA website (here). CBP officials recently said the agency would need to reassess the updates (see 1704040086), given a number of major changes that occurred since the form was submitted to the Office of Management and Budget about a year ago (see 1607130026). The updated form is considered a necessary step toward an importer of record database as required in the Trade Facilitation and Trade Enforcement Act (see 1612020008)

A notice of OMB action on the form (here) said "terms of the previous clearance remain in effect." The proposed updates would add several new data fields, some optional, including the DUNS Number for the Importer; and the Social Security and passport numbers for the company officers (see 1507240009).

It's not clear how CBP will go forward now and the agency didn't comment. According to an OIRA list of frequently asked questions (here), "any time during the OIRA review process, an agency may request withdrawal of its [Information Collection Request] from review," and the agency can "resubmit the ICR at a later date after further consideration."
