Trade-Related Court Cases Filed for Week of Aug. 31 - Sept. 6
The following lawsuits were filed at the Court of International Trade during the week of Aug 31 - Sept. 6:
CBP seeking $30,000 in penalties under 19 USC 1641 against Frank Pubins III, a licensed customs broker and permit qualifier of Trinity Customs Broker, Inc., for his alleged failure to pay duties and taxes to CBP on behalf of his clients. The complaint alleges Pubins took payment of duties from his importer clients without subsequently remitting those payments to CBP. #15-00249. Filed Sept. 2.
CBP seeks $45,374.21 in penalties and $8,228.20 in unpaid duties from Farhan Khan, dba Artistic Creations, for Khan's negligent misclassification of wine and beer bottle bags and bottle and can wraps. #15-00250. Filed Sept. 3.
​Appeals of CIT Decisions
The following appeals of Court of International Trade decisions were filed at the U.S. Court of Appeals for the Federal Circuit during the week of Aug. 31 - Sept. 6:
Tyco Fire Products challenging a July 10 decision on the tariff classification of its glass bulbs for use in fire sprinkler systems and water heaters. CBP ruled the products cannot be classified as machinery under chapter 84 because products containing glass must be mostly made of other materials, or include mechanical components, to be classified in that chapter (see 1507130061).
