Trade-Related Court Cases Filed for Week of Feb. 9-15

The following lawsuits were filed at the Court of International Trade during the week of Feb. 9-15:

Pacific World Corporation on the classification of artificial nails, including artificial nail kits. CBP classified the merchandise under subheading 3926.40.0000 (5.3%). Pacific World says it should have instead been classified under subheading 3304.30.0000 (free). #15-00040. Filed Feb. 11.

Brenntag Great Lakes on the classification of hydrophobic fumed silica. CBP classified the merchandise under subheading 3824.90.9290 (5%). Brenntag says it should have instead been classified under subheading 2811.22.5000 (free). #15-00041. Filed Feb. 12.

#1 Wholesale, Inc. challenging CBP's assessment of storage charges on "merchandise improperly seized and later released." #1 Wholesale says "CBP charges for fees covering more than two years of storage in a private contractor's warehouse are improper charges or exactions" and "equal an unconstitutional 'taking' under the fifth amendment to the U.S. Constitution." #15-00042.
