CBP Revises Cargo Release Policy for Facilities Still Using Paper Forms

CBP will allow non-automated facilities to release cargo based on-screen printouts from filers, said CBP on Jan. 26 (here). The change, made "on an interim basis," is meant to help with the transition to a paperless environment through the Automated Commercial Environment Cargo Release program, said CBP. CBP also released a list of cargo release capabilities by mode (here).

The paperless nature of the program means CBP will no longer be "stamping, perforating or signing courtesy 3461 copies moving forward," it said. The program also eliminates the requirement to present such copies to non-automated Container Freight Stations, bonded warehouses or terminal facilities for delivery of CBP-released cargo, it said. CBP will require all data for the release of cargo to be filed in ACE as of Nov. 1.

The printout should include "at a minimum the shipment ID and quantity being released, the type of release as well as clear identification of who presented the released information," it said. This satisfies the facility's due diligence for audit purposes, said CBP. "In the event that cargo that is unreleased or on hold is released from a non-automated facility where they received a release from the filer, CBP will seek remedy from the party who provided such information to the non-automated facility," the agency said. Record-keeping guidelines also apply, it said.
