Trade-Related Court Cases Filed for Week of Dec. 8-14

The following lawsuits were filed at the Court of International Trade during the week of Dec. 8-14:

Hartford Fire Insurance challenging CBP's claims on bonds covering entries of honey. Hartford says the claims should be canceled because the bonds contained facial defects. #14-00323. Summons filed Dec. 8.

Gerber Plumbing Fixtures challenging CBP's denial of its protests on the classification of ADA-compliant toilet bowls and tanks. CBP classified the merchandise under subheading 6310.10.0020 (5.8%). Gerber says it should have instead been classified under subheading 9817.00.96 (free). #14-00324. Summons filed Dec. 8.

Carbon Activated Corporation challenging the final results of the Commerce Department's 2012-13 antidumping duty administrative review on activated carbon from China. #14-00325. Complaint filed Dec. 9.

Calgon Carbon Corporation and Cabot Norit Americas challenging the final results of the Commerce Department's 2012-13 antidumping duty administrative review on activated carbon from China. #14-00326. Complaint filed Dec. 9.

US LED challenging CBP's denial of its protests on the classification of LEDs and LED devices. CBP classified the merchandise under subheadings 9405.30.00 (8%), 9405.40.60 (6%) and 9405.40.80 (3.9%). US LED says it should have instead been classified under subheadings 8540.40.20 (free) and 8543.70.70 (2%). #14-00327. Summons filed Dec. 10.

Otter Products challenging CBP's exclusion and order for redelivery of cellphone cases under a general exclusion order. #14-00328. Complaint filed Dec. 10.

Target Stores challenging CBP's denial of its protests on the classification of imported merchandise with holiday symbols, designs or themes. CBP classified the merchandise under various subheadings in chapters 39, 63, 42, 73 and 92 (3%-17.6%). Target says it should have instead been classified under subheadings 9505.60.6000, 9817.95.02, and 9817.95.05 (free). #14-00329. Summons filed Dec. 11.

DSM Nutritional Products challenging CBP's denial of its protests on the classification of carotenoids. CBP classified the merchandise under subheading 2106.90.99. DSM says it should have instead been classified under subheadings 3204.19.35 (3.1%), K3204.19.35 (free), and 2936.10.00 (free). #14-00330. Summons filed Dec. 11.

Target General Merchandise challenging CBP's denial of its protests on the classification of light sets. CBP classified the merchandise under subheading 9405.30.0010 (8%). Target says it should have instead been classified under subheading 9405.40.8000 (3.9%). #14-00331. Summons filed Dec. 12.

Clearon Corp. and Occidental Chemical Corp. challenging the final determination in the Commerce Department's countervailing duty investigation on chlorinated isocyanurates from China. #14-00332. Summons filed Dec. 12.
