Trade-Related Court Cases Filed for Week of Nov. 24-30

The following lawsuits were filed at the Court of International Trade during the week of Nov. 24-30:

United States seeking a $30,000 penalty against Los Angeles-based customs broker Paul Puentes for underdeclaring merchandise processing fee to CBP and keeping the proceeds from the correct amount collected from his client, filing 250 late entry summaries and failing to file another 58, and falsely identifying a company as importer of record on entry documentation. #14-00310. Complaint filed Nov. 25.

Commercial Metals Company challenging CBP's denial of its protests on the classification of proppants. CBP classified the merchandise under subheading 6909.19.5095 (4%). Cometals says it should have instead been classified under subheading 3824.90.3900 (free), 2818.20.0000 (free), or 2606.00.0060 (free). #14-00311. Summons filed Nov. 26.

Appeals of CIT Decisions

The following appeals of Court of International Trade decisions were filed at the U.S. Court of Appeals for the Federal Circuit during the week of Nov. 24-30:

Jiaxing Brother appealing a CIT decision that sustained the final results of the 2010-11 antidumping duty administrative review on steel threaded rod from China. #14-1161. Filed Nov. 25.

Nitek Electronics appealing a an order to pay $47,884.27 plus interest and costs to settle charges it failed to pay regular and antidumping duties. #15-1166. Filed Nov. 26.
