Trade-Related Court Cases Filed for Week of Nov. 3-9
The following lawsuits were filed at the Court of International Trade during the week of Nov. 3-9:
United States seeking penalties under Section 1582 against Costar, Inc. Costar allegedly misdeclared the country of origin of entries subject to antidumping duties on polyethylene retail carrier bags from China. The government seeks $879,987.44 in unpaid duties, and a penalty for negligence in the amount of $1,759,974.88. #14-00291. Complaint filed Nov. 4.
Roadtrek Motorhomes challenging CBP's denial of its protests on the classification of van-based motorhomes. CBP classified the merchandise under subheading 8703.24.00 (2.5%). Roadtrek says the motorhomes were only exported for repairs or alteration, and should have instead been classified under subheading 9802.00.50 (free). #14-00292. Summons filed Nov. 4.
Starkist challenging CBP's denial of its protests on the classification of prepared tuna products. CBP classified the merchandise under subheading 1604.14.10 (35%). Starkist says it should have instead been classified under subheading 1604.14.22 (6%) if in quota, or 1604.14.30 (12.5%) if out of quota. #14-00293. Summons filed Nov. 6.
Murray Feiss Corp. challenging CBP's denial of its protests on the classification of lighting fixtures. CBP classified the merchandise under subheadings 9405.10.6010 (7.6%) and 9405.91.3000 (12.4%). Murray Feiss says it should have instead been classified under subheading 9405.10.8010 or 9405.20.8010 (both 3.9%). #14-00294. Summons filed Nov. 7.
Marine Nutriceutical challenging CBP's denial of its protests on the classification of fish oil. CBP classified the merchandise under subheadings 1504.10.4000 (2.5%). Marine Nutriceutical says it should have instead been classified under subheading 3001.90.0190 (free). #14-00295. Summons filed Nov. 7.
