CBP Posts FAQs on C-TPAT for Exporters
CBP posted a set of frequently asked questions for the planned Customs-Trade Partnership Against Terrorism (C-TPAT) program for exporters, called C-TPAT Exporter Entity. The agency is in the process of updating the automated system to allow applications for the program, it said. While C-TPAT importers that can now receive export benefits with Japan and European Union due to mutual recognition arrangements, this program "is being launched to enable 'export only' businesses to enjoy C-TPAT benefits as well," it said. CBP recently posted a list of exporter eligibility requirements for participation in C-TPAT (see 14070921).
The program is intended to help grow exports and create benefits in multiple parts of the export process, the agency said. "C-TPAT Exporter Entity benefits will expedite the flow of trade out of the U.S," it said. "For countries whose customs authorities have signed a mutual recognition arrangement with the United States, exporters who participate will receive additional facilitation benefits into the foreign ports of entry. In the process of vetting their outbound supply chains, participating exporters are able to streamline their processes, which may lead to opportunities to save time, money, and efforts in the transportation of their cargo abroad." Within the program, the agency will identify the participants by employer identification number or Dun and Bradstreet number, it said.
The FAQs also mention concerns for exporters on the potential liability for export control violations in transactions in which there's "minimal control, visibility, and/or constantly challenged authority." CBP "asks that partners in the C-TPAT program do their part in securing the supply chain in exchange for benefits" and says members "are required to demonstrate due diligence in protecting the security of their supply chains." C-TPAT exporters are also encouraged, but not required, "to verify the soundness, stability, and ability of their business partners to take corrective action, as needed."
