India Steel Pipe: Preliminary CV Cash Deposit/Bond Rates Take Effect

The International Trade Administration made a preliminary affirmative countervailing duty determination that countervailable subsidies are being provided to exporter/manufacturers of circular welded carbon-quality steel pipe from India (C-533-853). The ITA found a preliminary CV rate 285.95%¹, which is effective on March 30, 2012. U.S. Customs and Border Protection is expected to implement these CV cash deposit/bond requirements soon.

Suspension of Liquidation Cash/Bond Requirements

The ITA is directing CBP to suspend liquidation of all entires of circular welded pipe from India that are entered, or withdrawn from warehouse, for consumption on or after March 30, 2012, and to require a CV cash deposit or bond for such entries of merchandise as follows:

¹The ITA states that the Government of India and the mandatory respondents Lloyds Metals and Zenith Birla did not respond to its requests for information, and therefore the ITA is applying an Adverse Facts Available (AFA) CV rate of 285.95% to the two mandatory respondents. The ITA also states that, as they have no other information to determine an "all-others" rate, the AFA rate of 285.95% will also apply to "all-others" exporters and manufacturers.
