China Solar Cells: Preliminary CV Cash Deposit/Bond Rates Take Effect
The International Trade Administration made a preliminary affirmative countervailing duty determination that countervailable subsidies are being provided to producers and exporters of crystalline silicon photovoltaic cells from China (C-570-980). The ITA found preliminary CV rates of 2.9% to 4.73% which, as a result of its preliminary determination of critical circumstances for both respondents and “all-others”, are effective on or about December 27, 2011. U.S. Customs and Border Protection is expected to implement these CV cash deposit/bond requirements soon.

CV Critical Circumstances, Suspension of Liquidation, and Cash/Bond Requirements
Because the ITA has preliminarily found that critical circumstances exist with respect to imports of solar cells from China for both respondents and all other Chinese producer/exporters (i.e., “All-Others”), the ITA is directing CBP to suspend liquidation and require a cash deposit of all entries of the subject merchandise that are entered or withdrawn from warehouse, for consumption on or after the date 90 days prior to the date of publication of this preliminary determination (i.e., on or about December 27, 2011).

ITA Amends Scope of Investigation to Cover 3rd Country Products w/ China Cells
The ITA said that, based on comments received, it amended the scope of the investigation to state that modules, laminates and panels produced in a third country from cells produced in China are covered by this investigation, but that modules, laminates, and panels produced in China from cells produced in a third country are not covered.
