Opportunity to Request AD/CV Admin Reviews for OJ, Pipe, Etc.

The International Trade Administration is announcing the opportunity to request administrative reviews by April 2, 2012 for producers and exporters subject to 17 antidumping orders and 5 countervailing duty orders with March anniversary dates. Affected products include orange juice, stainless steel bar, polyvinyl alcohol, etc.

(If the review request involves a non-market economy (China or Vietnam) and the parties subject to the review request do not qualify for separate rates, all other exporters of subject merchandise from the NME who do not have a separate rate will be covered by the review as part of the single entity of which the named firms are a part.)

If No Review Request, CBP to Assess AD/CV Duties Equal to Deposit Estimate

If the ITA does not receive, by April 2, 2012, a request for an administrative review of entries covered by an AD or CV duty order or suspension agreement listed above for the identified review period, it will instruct U.S. Customs and Border Protection (CBP) to assess AD/CV duties on those entries at a rate equal to the cash deposit of (or bond for) estimated AD/CV duties required on those entries at the time of entry, and to continue to collect the cash deposit previously ordered.

The ITA states that in 2003 it clarified its practice with respect to the collection of final antidumping duties on imports of merchandise where intermediate firms are involved, and that the public should be aware of this clarification in determining whether to request an administrative review. 1ITA states that in the notice of opportunity to request administrative review that was published on February 1, 2012 the ITA incorrectly listed Drill Pipe from China in the month of February. The ITA clarifies that March is the correct month of review for this case.
